Third-Party Data Services Agreement

NOTE: If you are a El Paso Electric Company customer trying to share data with a third party, your use of this service is covered by the Account Holder Authorization and Agreement.

This Data Services Agreement (this "Agreement") is entered into by and between El Paso Electric Company ("EPE") and the third party entity identified as the company seeking to obtain data services from EPE ("Company" or "You"). This Agreement is effective as of the day you check a box indicating your agreement with the terms of this Agreement (the "Effective Date").

If you don't agree to this Agreement, do not use register or use this service.

EPE uses the UtilityAPI, Inc. platform and services for third party functionality. When you register to use this Service, an account will be created on UtilityAPI's system that you will use to manage your settings and access advanced meter data, including meter data used to calculate charges for service, historical load data, and any other proprietary customer information (“Utility Data”) that EPE’s retail customers have consented to share with you by accepting EPE’s Account Holder Authorization and Agreement (“Utility Account Holders”). By agreeing to this Agreement, you also agree to the UtilityAPI Data Services Agreement.

In addition to the UtilityAPI Usage Restrictions, you agree to the following additional usage restrictions.

Company will not:

  1. Obtain Utility Data from EPE customers who receive service at transmission voltage for any reason.
  2. Access Utility Data outside of EPE’s secure web portal through which only secure, read-only Advanced Metering System usage data is available.
  3. Disseminate, publish, sell, disclose, or otherwise share Utility Data with any other person or entity, including Company employees without a “need to know,” for any reason.
  4. Disseminate, publish, sell, disclose, or otherwise share Utility Data with Company affiliates or subcontractors for any reason, unless the Company affiliate or subcontractor executes a separate Data Services Agreement with EPE containing provisions substantially similar to the provisions in this Agreement.
  5. Access and receive authorizations directly from EPE customers in “live mode” without prior review and approval by EPE.

In addition to the UtilityAPI Company Responsibilities, you agree to the following additional Company responsibilities.

Company will:

  1. Maintain registration with EPE to use the UtilityAPI, Inc. platform before accessing any Utility Data. If any Company information contained in your registration form changes in any way, you will update the registration form before accessing any additional Utility Data.
  2. Complete API and OAUTH 2.0 connectivity testing before accessing Utility Data.
  3. Ensure that each EPE customer which shares data with the Company has specifically granted the Company authorization to access the customer’s individual utility data and that the Company has exchanged the authorization code for an access token for each Customer’s Utility Data.
  4. Only access Utility Data in read-only formats such as CSV, JSON, and XML.
